 Environmental Agreement Minimize


The Environmental Agreement was negotiated to address environmental concerns that were not covered by existing legislation and regulations.  It was signed by BHP Billiton Diamonds Inc., Government of Canada, and Government of the Northwest Territories on January 6, 1997.  Article V establishes the Independent Environmental Monitoring Agency and its mandate.  On April 14, 2003 an Addendum was signed, making changes to some of the original clauses.

Dispute Resolution

Article XV of the Environmental Agreement describes the dispute resolution process.  This process has been initiated twice so far since the Agency was established.  All Parties to the Environmental Agreement (BHP Billiton Diamonds Inc., the Agency, and Governments of Canada and the NWT) are involvedBHP .

In 2005-2006, the main issues of dispute were the Agency's mandate, workplan and budget.  A mediator was appointed, and on January 17, 2006 the Mediator's Report and Resolution Agreement (2006) was signed. 

In 2007-2008, the main issues of dispute were again the Agency's mandate, workplan and budget (specifically access to a Separate Fund).  A mediator was appointed, and on March 5, 2008 the Mediator's Report and Resolution Agreement (2008) was signed.
