Environmental Agreement

The Environmental Agreement was negotiated to address environmental concerns that were not covered by existing legislation and regulations. The Environmental Agreement was signed on January 6, 1997 by BHP Billiton Diamonds Inc., the Government of Canada and the Government of the Northwest Territories. On April 14, 2003, an Addendum was signed, making changes to some of the original clauses.
Article IV of the Environmental Agreement established the Independent Environmental Monitoring Agency and its mandate.

Article XIV of the Environmental Agreement describes the dispute resolution process for resolving matters arising from the Environmental Agreement. The Agency and all Parties to the Environmental Agreement are involved in the dispute resolution process.
The dispute resolution process has been initiated twice since the Agency was established. First, in 2005-2006, the main issues of dispute were the Agency's mandate, workplan and budget. A mediator was appointed, and on January 17, 2006 the Mediator's Report and Resolution Agreement (2006) was signed. In 2007-2008, again the main issues of dispute were the Agency's mandate, workplan and budget (specifically, access to a Separate Fund). A mediator was appointed, and on March 5, 2008 the Mediator's Report and Resolution Agreement (2008) was signed.
